These Terms & Conditions apply to all trainings, courses, workshops, online content, bookings, agreements and services offered under the brand name BUTT. Academy, operated by Scentique BNLX.

2. Definitions

In these Terms & Conditions, the following definitions apply:

  • Academy: BUTT. Academy, operated by Scentique BNLX.
  • Student / Participant: any individual or business purchasing or participating in a training or service.
  • Training: any physical or digital training, workshop, private training, group training or educational service offered by the Academy.
  • Model: a person receiving practical treatments during a training session.
  • Online Content: digital learning materials including videos, PDFs, guides, scripts and educational content.

3. Applicability

3.1 These Terms & Conditions apply to all offers, bookings, agreements, purchases and services
provided by BUTT. Academy.
3.2 By booking a training, the participant agrees to these Terms & Conditions.
3.3 Any deviations from these Terms are only valid if confirmed in writing by the Academy.
3.4 The Academy reserves the right to modify these Terms & Conditions at any time .

4. Trainings and Participation

4.1 Trainings are offered by appointment only and not through a fixed semester system.
4.2 Trainings may take place:
• in Helmond;
• at the participant’s location;
• online (if offered);
• or at another location selected by the Academy.
4.3 Trainings may be held individually (1-on-1) or in small groups.
4.4 The standard duration of a training is one day. If necessary, the training may be extended to
provide sufficient practical guidance.
4.5 The Academy reserves the right to change training dates, times, locations, trainers or training
content if necessary.
4.6 The Academy may work with external trainers, guest educators or third parties.

5. Training Languages

5.1 Trainings may be provided in:
• English;
• Croatian;
• Serbian;
• Bosnian;
• partially in Polish/English;
depending on availability.
5.2 Participants are responsible for ensuring they sufficiently understand the language used during
the training.

6. Registration and Payment

6.1 A booking becomes final once payment has been successfully processed.
6.2 Payments are processed through the available payment providers, including Mollie and Klarna.
6.3 Any conditions of third-party payment providers remain applicable.
6.4 Even when paying through Klarna, the participant remains responsible for full payment of the
training.
6.5 All prices listed on the website include VAT unless stated otherwise.

7. Cancellation, Rescheduling and No-Show

7.1 Consumers have the right to withdraw from their purchase within 14 days after the date of purchase, without giving any reason, in accordance with Dutch and European consumer protection legislation.

7.2 Withdrawal requests can be submitted through the digital withdrawal function (the withdrawal button) made directly and permanently available on the Academy’s website, in accordance with Article 6:230oa of the Dutch Civil Code (BW).

7.3 If a participant expressly requests the training to take place within the 14-day withdrawal period, the participant agrees that the performance of the service begins before the end of the withdrawal period. The participant must provide an express (digital) statement and waiver of rights prior to the training. The participant further acknowledges that the statutory right of withdrawal is completely lost once the training has been fully performed, in accordance with applicable Dutch and European consumer protection legislation.

7.3a If the participant withdraws from the contract after the performance of the service has begun at their express request (as defined in Article 7.3), but before the training is fully performed, the participant owes the Academy a proportional compensation for the preparation costs already incurred, in accordance with Article 6:230s paragraph 4 of the Dutch Civil Code (BW). These costs include the actual and non-refundable expenses incurred for organizing the urgent training (such as reserved location rent, model fees, and consumed materials). The exact amount of these costs will be communicated to the participant prior to the confirmation of the urgent training date.

7.4 Once the 14-day withdrawal period has expired, or if the right of withdrawal has legally expired in accordance with Article 7.3, payments are generally non-refundable due to limited availability, preparation time and reserved training capacity.

7.5 Outside of the statutory withdrawal period, participants may reschedule a training free of charge under the following conditions:

more than 14 days before the training: maximum 2 free reschedules;

between 14 days and 48 hours before the training: maximum 1 reschedule;

less than 48 hours before the training: considered a no-show.

7.6 In case of a no-show, the right to participate, receive a refund or free rescheduling expires.

7.7 In exceptional circumstances, the Academy may, at its sole discretion, offer an alternative solution.

7.8 If the Academy cancels a training, the participant is entitled to:

a new training date; or a full refund.

8. Travel Costs

Travel costs may apply for trainings held at the participant’s location. Any applicable travel costs will be communicated and agreed upon in advance.

9. Age and Participation Requirements

9.1 Participation in trainings is only permitted for individuals aged 18 years or older.
9.2 The Academy reserves the right to refuse participation or immediately remove a participant
from the training in case of:
• disruptive behaviour;
• aggression;
• unprofessional conduct;
• unhygienic working practices;
• unsafe behaviour;
• disrespect towards trainers, models or other participants.
9.3 In such cases, no refund will be issued.

10. Practical Work, Models and Health

10.1 Practical work may be performed on models during trainings.
10.2 Models must provide prior consent through a consent form.
10.3 Participants are responsible for informing the Academy about:
• allergies;
• medical conditions;
• skin conditions;
• contraindications;
• pregnancy;
• or any other relevant health information.
10.4 Participation in practical activities is entirely at the participant’s own risk.
10.5 Participants remain fully responsible for the safe application of techniques on future clients.
10.6 If the participant cannot provide a model, the Academy may attempt to assist, but cannot
guarantee model availability.

11. Medical Disclaimer

11.1 The trainings provided by BUTT. Academy are educational only.
11.2 The Academy does not provide medical education and does not issue medical qualifications.
11.3 Treatments and techniques taught are not a substitute for medical advice, diagnosis or
treatment.
11.4 Participants are responsible for complying with local laws and regulations regarding the
professional performance of treatments.
11.5 Treatment results vary from person to person.
11.6 Results shown on social media, websites or marketing materials may vary per individual.

12. Certification

12.1 Certificates are only issued if the participant:
• demonstrates sufficient practical understanding;
• works safely and hygienically;
• correctly performs the techniques;
• displays professional behaviour.
12.2 Certification is not automatically guaranteed.
12.3 The Academy reserves the right to refuse certification if the participant does not demonstrate
sufficient practical competence or understanding.

13. Intellectual Property

13.1 All educational materials, scripts, guides, videos, techniques, concepts, methods and content
remain the intellectual property of BUTT. Academy.
13.2 Without written permission, it is prohibited to:
• copy educational materials;
• distribute content;
• record trainings or videos;
• reproduce trainings or methods;
• commercially use the materials;
• provide trainings based on the Academy’s materials.
13.3 Full recording of trainings is strictly prohibited.
13.4 Limited photos or short behind-the-scenes content may only be created with permission from
the Academy

14. Confidentiality

14.1 Participants agree to treat internal knowledge, teaching methods, business information,
strategies and educational content as confidential.
14.2 Without written permission from the Academy, such information may not be disclosed or
commercially used.

15. Photo and Video Material

15.1 Photos and videos may be created during trainings for educational and marketing purposes.
15.2 Participants consent to this unless they inform the Academy otherwise in writing beforehand.
15.3 The Academy reserves the right to use such material on websites, social media and marketing
channels.

16. Online Content and Digital Products

16.1 The Academy may offer online trainings, videos, PDFs or other digital educational content in
the future.
16.2 Access to digital content is personal and may not be shared.
16.3 Reselling, distributing or sharing accounts or digital content is prohibited.

17. Liability

17.1 The Academy is only liable for direct damages in cases of intentional misconduct or gross
negligence.
17.2 The Academy is not liable for:
• indirect damages;
• loss of income;
• loss of clients;
• incorrect use of techniques;
• allergic reactions;
• treatment outcomes;
• professional or business success of participants.
17.3 Participation in trainings is entirely at the participant’s own responsibility.
17.4 The Academy’s maximum liability is limited to the amount paid for the relevant training

18. Force Majeure

18.1 The Academy is not liable for delays, changes or cancellations caused by force majeure.
18.2 Force majeure includes but is not limited to:
• illness;
• government measures;
• epidemics;
• technical failures;
• natural disasters;
• transportation issues;
• unforeseen circumstances.

19. Applicable Law

19.1 All agreements are governed by Dutch law.
19.2 Any disputes shall be submitted to the competent court in the Netherlands.
